Corporate manslaughter update

Although these are difficult times for many businesses, cutting back on health and safety expenditure is certainly not recommended.  According to a recent article in The Telegraph, the number of corporate manslaughter cases opened by the Crown Prosecution Service jumped by 40% last year as prosecutors stepped up their use of recent legislation.

Whilst there have only been three convictions so far, this could be the tip of the iceberg as there are 56 corporate manslaughter prosecutions pending. The charge can be used where deaths are caused by management failures where there was a gross breach of a duty of care.

Besides highlighting the need for a robust health and safety policy, directors should ensure that they have adequate management liability insurance to provide legal defence cost which can run into thousands of pounds.  Management liability Insurance with a corporate liability extension will provide cover for the company as well as for the individual directors and officers.
